Option 3: Collaborative Law

Collaborative practice is a private confidential process in which both parties to a dispute and their attorneys and possibly other professionals such as skilled financial experts and coaches commit to resolving a conflict using a cooperative rather than an adversarial approach. Collaborative practice allows the parties to avoid going to court, while still retaining the advantages of advocacy provided by their respective attorneys. Collaborative practice works when the parties and their attorneys are committed to honesty, cooperation, professionalism, compassion, and integrity. In collaborative practice, Ms. Holley serves as an advocate for one party while a separate collaborative attorney represents the other party. She uses her communication and listening skills to ensure everyone has fully heard and understood the concerns of all involved. Everyone agrees in writing that the matter will be resolved outside of court.

The difference between mediation and collaboration is that in the former case, Ms. Holley is an impartial expert helping to frame solutions in the interests of both parties while in the latter, she is an advocate for her client, working in concert with the other party and his/her attorney and any other professional team members to reach an equitable settlement between the parties.
